1. Services Provided
Fir Shore Consulting Ltd., doing business as "Fir Shore Forest Management" ("the Company") provides professional forest management and wildfire risk consulting services. By requesting a quote, booking an assessment, or moving forward with a service you agree to these terms.
2. Definition of Wildfire Events
For the purposes of these Terms, "Wildfire" is defined in the broadest possible sense. This includes, but is not limited to: forest fires, brush fires, grass fires, wildland-urban interface fires, and any fire behavior involving natural or ornamental vegetation. This definition applies regardless of the cause of ignition (including lightning, human activity, or accidental spread) and encompasses all associated effects, including heat, smoke, embers, and atmospheric conditions.
3. Professional Opinion & Liability
Professional services and reports provided by the Company are based on the environmental conditions present at the time of inspection. While our recommendations follow BC FireSmart™ and professional forestry standards, the Company does not guarantee that a property will be immune to wildfire damage or loss. Fire behavior is unpredictable and subject to environmental factors such as weather, topography, and extreme events. Wildfire management, suppression, and prevention involves a variety of agencies outside of the control of the Company.
4. Scope of Expertise & Exclusions
While the Company’s principal brings significant experience from the structural firefighting sector, the advice and reports provided, including hazard assessments, prescriptions, and action plans, are based on forest science and professional forestry standards. They do not constitute a structural fire safety inspection, building code audit, or life-safety system evaluation. This service specifically excludes assessments of interior fire risks, electrical systems, or structural integrity. Clients seeking evaluations of internal fire suppression or similar should consult with the appropriate authority having jurisdiction.
5. Client Responsibilities
Clients are responsible for providing accurate property and development information and allowing safe access to the land. Any recommendations provided in an assessment report are the responsibility of the client to implement.
6. Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Fir Shore Forest Management, its officers, employees, and contractors from any claims, damages, or losses arising from wildfire events. Our liability for any professional error, act, or omission shall be limited to the amount actually paid by you for the specific service rendered. You agree that you will not hold the Company liable for consequential damages, including property loss or business interruption.
7. Intellectual Property
All reports, maps, and digital data produced by the Company remain the intellectual property of Fir Shore Forest Management until full payment is received. Clients are granted a license to use these documents for personal or municipal permit purposes.
8. Governing Law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
